A Raleigh County man pleaded guilty Thursday to repeatedly faking compliant water quality standards for coal companies, in a case that raises questions about the self-reporting system state and federal regulators use as a central tool to judge if the mining industry is following pollution limits.

John W. Shelton, 47, of Daniels, admitted to a charge of conspiracy to violate the federal Clean Water Act, saying he diluted water samples, substituted water he knew to be clean for actual mining discharges and did not keep water samples refrigerated, as required by state and federal rules, court records show.

Shelton was a field technician, and then a field supervisor, for Appalachian Laboratories Inc., a Beckley company that was certified by the West Virginia Department of Environmental Protection to sample and analyze water discharges from mining operations as part of the Clean Water Act program.

In a criminal charge filed in early September, Assistant U.S. Attorney Blaire Malkin alleged that Shelton took part in a conspiracy from the time of his hiring at Appalachian Laboratories, in 2008, through at least June 2013.

“The objects of the conspiracy were to increase the profitability of Appalachian by avoiding certain costs associated with full compliance with the Clean Water Act and to maintain and increase its revenue by providing its customers and the agencies regulating those customers with reports purporting to show that those customers were operating their sites in compliance with the CWA and thereby allow those customers to avoid fines and other costs associated with bringing their operations into compliance with the CWA and thus encourage and maintain for Appalachian the patronage of those customers,” the charging document alleged.

Appalachian Laboratories officials did not return a phone call seeking comment for this story. Other coal industry officials also did not respond to a request for comment.

In an agreed-to “stipulation of facts” filed in court Thursday, prosecutors and Shelton said that, throughout his time with the company, another Appalachian Laboratories official — referred to as “First Known Person” — stressed to him the importance of “pulling good samples,” a term that was understood to mean samples that would comply with permit limits, not necessarily samples that were taken properly.

Among other things, the stipulation says that employees of Appalachian did not maintain water samples at the proper temperature, by putting them on ice in coolers, unless they knew that DEP inspectors were in the area.

Shelton and other Appalachian employees “falsified and rendered inaccurate” water samples by diluting them with distilled water or replacing them with water they knew to be in compliance with permit standards, according to the stipulation. The document says that Appalachian officials used the term “honeyhole” to refer to water from certain sites that would always test within permit limits and could be used in place of or to dilute “bad water.”

“Each time that Shelton and others at Appalachian diluted the sample water or replaced the sample water with water that would pass, they allowed water that they believed exceeded permit limits to discharge into the waters of the United States,” the stipulation stated.

Shelton pleaded guilty Thursday afternoon before U.S. District Judge Irene Berger and was released on $10,000 bail. He faces up to five years in jail and a fine of up to $250,000 when he is sentenced on Feb. 26, 2015.

U.S. Attorney Booth Goodwin said his office’s investigation into the water sampling issue, conducted jointly with the FBI and the U.S. Environmental Protection Agency, is continuing, but he did not offer further details.

David McLeon, special agent in charge of the EPA’s regional criminal enforcement program, said Shelton’s plea “demonstrates that laboratories and their senior managers who callously place the American people at risk by submitting false reports will be held accountable.”

Prosecutors said Appalachian does water sampling for more than 100 mine sites in West Virginia. Court records, though, do not indicate which mining operations were involved in the falsified samples or how widespread a problem Shelton’s plea indicates exists.

Under the Clean Water Act, companies with water pollution permits are required to take periodic samples and submit reports to the DEP on whether those samples indicate their operations are in compliance with allowed pollution discharge limits. State and federal agencies take some samples themselves, but the majority of sampling is done by companies, with results filed with the government for its review.

Problems with this system have come up before in West Virginia. In 2008, after federal officials sued Massey Energy over widespread water violations at its mines in the state, DEP officials revealed that, for about five years, they had not been monitoring the discharge reports filed with them by the coal-mining industry. Agency officials said that problem has been remedied.

Derek Teaney, senior staff attorney with the group Appalachian Mountain Advocates, said the DEP — the state agency with primary Clean Water Act responsibility in West Virginia — needs to investigate what was going on with Appalachian Laboratories. Teaney said the DEP should audit any water quality sampling performed by Appalachian Laboratories and, perhaps, do an increased program of its own sampling at mines that could have been involved.

“The whole Clean Water Act system relies on self-reporting,” said Teaney, whose group monitors coal industry compliance and files lawsuits against water quality violators. “If that self-reporting can’t be trusted, then the system just falls apart.”

Kelley Gillenwater, a spokeswoman for the DEP, said the agency gave federal investigators all the results it had from water sampling performed by Appalachian Laboratories.

“We haven’t, at this time, conducted any additional testing at those sites because of these allegations but have continued with our routine field sampling,” Gillenwater said.

The DEP Division of Mining and Reclamation’s goal for each quarter is to conduct its own field sampling for at least 25 percent of water pollution outlets, so that all outlets are sampled at least once annually, Gillenwater said.

Due to time constraints & some new equipment invesments I will be moving this blog format to more of a V (video) LOG format.  I have procured some new broadcasting software & microphones which allows me to publish a much denser report in a much shorter period of time, than I have done in the past.  The events unfold too fast anyway for me to report on them in a timely manner, especially so since I don’t have a crew supporting me, so this will be I hope a more effective way to communicate.

Attention Durham Against Fluoride Readers:

You are officially notified that I  will be attending the 5th Citizen’s Conference On Fluoride, in Crystal City Virginia this coming Friday – Sunday (September 5 – 7).

On this weekend it is here that activists, researchers & hundreds of other transnational truthseekers will convene to collectively raise the global awareness quotient on the most massive public health fraud in human history & certain crime against humanity; public water fluoridation.

As you can see from the agenda details below – in attendance will be a dizzying array of fascinating individuals, of differing backgrounds & from all over the planet who have contributed enormous energies to this cause.   To my estimation this means there is no more seminal a conference taking place anywhere on earth this year, for beings who want to forever unglue a core deception in eugenics based approach to Government, than this one!

Therefore I will contribute my energies in the form of attendance, with Camera & Microphone in hand, to meet, greet, interview, discuss, all the issues of the day regarding Fluoride.  If you recognize me – please don’t hesitate to approach!  I will be accompanied by compatriot Eric B, who appeared with me in a crucial 1 hour dissection of the Sociological Significance of Durham North Carolina & the “Research Triangle Park” in the mass Fluoridation scheme.  Together we will be capturing  audio/video of the different sessions as well as in-person interviews.

To fully grasp this writer’s struggle so far, one only has to browse in chronological order all the posts of this website which first originated in January 2012.

To summarize, DurhamAgainstFluoride.com was re-actively created, in a very disorganized ad-hoc way rather than in some deliberate premeditated manner.  After some self reflection I learn the core reason for this approach; I had way too much trust in my city council to rationally, objectively evaluate the evidence which I first presented to them in December 2011.  Nearly 3 years later I could have initially never imagined how deep & sinister this policy actually went. When I was summarily dismissed after presenting hardcore evidence that should make even the most dumbed down person agree Public Water Fluoridation violates the Precautionary Principle,  my soul was given no choice but to do something.  Combined with a total lack of uncompromised media made for fertile breeding grounds for resistance & this spells the basic genesis of DurhamAgainstFluoride.com

I must admit the local WTVD Channel 11 team later changed this dynamic with their mostly fair 2012 piece, featuring yours truly & entitled “How Safe is Fluoride In Our Water,” but some unknown force has made the media be largely quiet on the issue since then.

Fast forward to today, almost 3 years later & materially nothing has changed in the City of Durham.  I was forcibly removed by deputy Sheriff at one point for exposing the facts in a so-called “public health board meeting”,  a fact WTVD declined to report.  The city government with their vast stolen resources  & copious use of  the CIA plausible deniability tactic have heretofore successfully stifled my efforts to alert the unconscious public. All of this is well illustrated in my 2013 documentary “21st Century Dawes Project.

Therefore the council continues resting on its illegitimate claim to wisdom, continues buying massive quantities of fluorosilicic acid from MOSAIC fertilizer company, and charges you money to dispose of it in your tap water with or without your consent.  Meanwhile America has seen historic coal ash spills in North Carolina & epic public health crimes in West Virginia, all enumerating precisely why our local municipal governments are completely untrustworthy to manage our most precious natural resource; water.

In spirit of resisting these developments I hope to see you in Crystal City.

I am writing to notify you that there is a toxic, hazardous substance currently added to the Orange County water supply. This substance is fluoride. After repeated inquiries into this matter with the OWASA board members, we have still not been told what kind of fluoride is added to the water. My peers who oppose the addition of the level 3 or 4 health hazard toxin known as fluoride suspect that the kind of fluoride currently added to the water is fluorosilic acid and that, when this kind of fluoride hits one’s stomach acid, it transforms into Hydrogen Fluoride, a level four (4) health hazard as rated by the NFPA fire diamonds seen:

Fluosilicic Acid: “Agent in water fluoridation, in preliminary treatment of hides and skins, and to reduce reflectivity in glass surfaces; disinfectant for copper and brass vessels; impregnating ingredient to preserve wood and to harden masonary; chem intermediate for aluminum trifluoride, cryolite, and fluorsilicates; electroplating agent for chromium.

Furthermore, Sodium fluoride pills are a prescription drug with NDC (National Drug Code) # 0288-1106-10 and NDC # 68032-382-12 (to name just two) – their primary purpose to deliver fluoride (fluorine) to the teeth through what I consider the pseudo-science of its being beneficial when contained in the saliva and “bathing the teeth” in fluoride continuously throughout the day. At least ten different citizens have challenged the OWASA board’s continued addition of fluoride (a by-product of the aluminum and fertilizer industries by their own admission on their website) with valid, cogent arguments against the addition of this drug into the water supply against their consent.

We got nowhere with the board.

Notably – the recently dismissed “State Dentist” Rebecca King (See:Tense meeting with DHHS leader Wos leads to firing of NC’s top dentist) – gave her “testimony” (“expert” opinion) on the subject in a meeting that was exempt from public comment, and she used a tactic coined by Orwell as “Double Speak” on more than one occasion.  She stated word for word, and I have this on record,

“Fluoride is not a by-product of the fertilizer industry. Fluoride comes from the same phosphate rock that is used to create fertilizer – it does not come from fertilizer.”

So, somehow these two things (phosphate mining and fertilizer production) are not correlated even though fluoride comes from the same phosphate rock used to produce fertilizer? If fluoride were not pumped into the public water supplies of practically every North Carolina township, what would the phosphate mining companies do with all of the fluoride?

They would have to pay to dispose of it as what it is – toxic waste, which they do not want to do.

We confronted the OWASA board about this specific inconsistency in the pro-fluoride argument (position), among many, many others (for emphasis), and each time, they denied it – repeatedly stating that the fluoride they used did not come from the fertilizer and aluminum industries, until finally – Corey Sturmer, an anti-fluoride activist brought out into the open a print out of their own website (water quality report card) that stated their source of fluoride was phosphate rock from byproducts of the fertilizer and aluminum industry.  See:

Finally, they were forced to have one of their operational employees come to the meeting and give a statement about how the fluoride they used actually did come from the by-products of a North Carolina phosphate rock-mining plant which supplied the fertilizer industry. We have all of these encounters on video.

This was just one example of misleading double-speak they used. They also denied direct response to our questions/points and neglected due diligence of researching the facts we presented to them. Otherwise, why would they have come to the decision to continue fluoridating the public water supply? We have them on record stating that it does not have a benefit to the safety of the water that so many people in this town drink.

They are not open about their actions, nor are they forthcoming with information that should be public.   For example, I have asked them numerous times if they use sodium fluoride or a kind of fluorosilic acid, and they have not told me which one they use. I have asked them to address what gives them the right to give out a drug to unwitting people when they are admittedly not health professionals. They are the ones who add fluoride to the water and set the quantity of fluoride added. What are they doing adding fluoride to the water when they are not health professionals? They are not elected, but rather are an ad hoc committee. This goes against the constitution of North Carolina.

I am writing to implore you to re-examine the policies of the OWASA board.

Think about these things, and ask yourself these questions:

  1. The supposed purpose of the water fluoridation is supposedly for hardening the enamel of the teeth through the saliva. Fluoride has an NDC # (National Drug Code Number). Is it ethical to give a drug to everyone – or put otherwise – to discriminate against those who would not like to take the drug fluoride by forcing them to obtain fresh water sources and denying them public water?
  2. If I drink one liter of OWASA water, I would be taking the equivalent of .7 mg of fluoride. If I were to drink to two liters of OWASA water, that means I would get 1.4 mgs of fluoride. The NDC # is relevant to doses of only .25 mg. per day. Think about that. This is huge over exposure if you are just drinking a regular amount of water. The board is drugging the population.
  3. Could the right to freedom of religion be violated by the addition of a toxin to the water supply? Muslims must use clean water, free of toxins for their prayers. Fluoride is a toxin and health hazard.
  4. How can one ethically put a substance in the public water supply that has been linked to decreased bone density and lowered IQ in a Harvard Medical Journal study: http://www.hsph.harvard.edu/news/features/fluoride-childrens-health-grandjean-choi/
  5. Has OWASA exceeded their charter in attempting to forcibly (covertly) drug the entire population? YES! OWASA’s charter allows them to provide clean water, not give drugs to the general population.
  6. Fluoride pacifies people and makes them more complacent. This characteristic was used by Hitler, Stalin, and numerous other dictators to pacify the population and coerce them more easily into going along with totalitarian, facist ideologies. Why would we risk this in our own society by fluoridating the public?
  7. WATER FLUORIDATION WAS JUST BANNED BY THE COUNTRY OF ISRAEL, STOPPED IN PORTLAND, OREGON AND IS GAINING MOMENTUM AS AN ISSUE OPPOSED BY AN AWAKENED PUBLIC.

The reality is that there a growing number of concerned citizens believe or at least question not only the validity of fluoride science, but the ethicality, potential of severely harmful side effects (on the human body through accumulation in the environment and over exposure), and true purpose of water fluoridation. We stand against water fluoridation whole-heartedly and believe fluoride should be avoided.

In my last report, you journeyed with me through the “Customer Service Hotline” of Durham’s Water Management Department, where I attempted to get a discount on my water bill that would account for the fluoridation chemicals forcefully added to our water since 1957.  I figured & I’m sure most red-blooded Americans would agree, that we should not have to pay for medication we never agreed to purchase.

As you may remember, this was a failed attempt insofar as no discount was ever rendered but the discussion was nevertheless successful in exposing the unfortunate reality that the individual in Durham North Carolina is left with absolutely no recourse if he disagrees with the communist-inspired social engineering thrust upon his drinking water, which is medicated against his consent.  In typical fashion I was treated like a real hot potato by the powers that be in Durham before eventually being reminded that, despite my wishes, I would still be forced to pay the same rate for my water even though nobody debated the legality of systematically medicating the water supply or so much as acknowledged the outright violation of our rights.

Left with no recourse, I decided to pursue a different course on this issue and attempted to file a criminal police report with the Durham Police Department, since I have never once met an individual willing to argue that drugging someone else’s water is a legal & lawful thing to do.  As you will see, I make a quick transformation from an enthusiastic mid-twenty something into a veritable turd subsequently passed from one governmental intestinal tract to another.

It is clear from the onset that this is an issue nobody in our government is either knowledgeable about or has any authority to change, which also happens to be a leitmotif of this effort since its early beginnings in 2011.  Listen! and you will hear me being passed from supervisor to supervisor, in a familiar methodology which inevitably leads me to a kind but ignorant Durham Police Officer who sums up the City’s stance on fluoridation perfectly when I pose the simple question:

“What will happen to the police report after it is filed?”

Officer Smith of the Durham Police Department replies:

“To be honest sir, absolutely nothing.”

With only one day before Thanksgiving 2013, I could not resist raising a little hell with the Durham Water Management department before everyone goes on holiday break.

This time I took a slightly different angle compared to my past anti-Fluoridation efforts, & requested a discount on my water supply from the “Customer Service” folks within the corporate government who have seized the most important public resource humans can call our own – WATER

Why?

Because I do not consent & have never voted for the illegal policy of drugging my drinking water to foment in the first place, therefore it is unconscionable that I should have to remunerate the corporate government for it. So yet again, I enter the maze of city hall & try my hardest to ‘get through’ to the individuals perpetrating this heinous violation of our medical & civil rights by asking that they discount my water bill or eliminate it completely.

As you will see, the “customer” is left with absolutely no recourse if s/he is not happy with the ‘service’ being provided. What is astonishing about this service however is that it is not a luxury or a want, contrary to something like electricity.  Water is a need since human beings require water for survival & their cells are composed of approximately 70% water… yet the fate of that water rests in an uncooperative bureaucracy of people who astonishingly, are themselves unaware of the fact that it is illegal to drug the water supply as they do on a daily basis!

Ironically, in this exchange I am eventually sent up the ladder until I meet with my old nemesis, Assistant Director of Water Management Vicki Westbrook, who has appeared at nearly every crossroads during my 2 year effort, in order to help mitigate any damage I happen to inflict on the illusion of the government inspired public water fluoridation scheme. Just see the City’s response to WTVD’s 2012 Investigative Report:

If you listen to the conversation to its end, you will hear Vicki Westbrook admit that there is no law requiring the city to add fluoride to our water supply, so there is no legal barrier holding them back from removing it… they are instead content to sit on their hands and do not plan on removing it until the citizenry rise up & demand a change.  This validates my conclusion that the main impediment to making this change is awareness about the policy, moreso than it is about the policy itself.
